Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between TransferFix LLP ("TransferFix," "Company," "We," "Us," or "Our") and the user ("User," "You," "Your") regarding your access to and use of the TransferFix website and platform services.

1. NATURE OF SERVICE

TransferFix is a technology-driven intermediary platform designed to facilitate vehicle-related data retrieval and legal record-keeping.

Intermediary Status: We operate as an "Intermediary" under Section 2(1)(w) of the Information Technology Act, 2000.

No Legal Practice: TransferFix is NOT a law firm. We do not provide legal advice. The "Shield" service involves document automation and dispatch facilitated by independent third-party panel lawyers.

No Guarantee of RTO Action: We facilitate the creation of a legal paper trail. We do not guarantee that the Regional Transport Office (RTO) or any law enforcement agency will immediately update their records based solely on the notices dispatched.

2. ELIGIBILITY AND REGISTRATION

You must be at least 18 years of age and possess the legal authority to enter into a binding contract.

To access certain features (Connect/Shield), you must register an account and verify your identity via our approved verification partners (e.g., DigiLocker/Aadhaar masking).

You agree to provide accurate, current, and complete information during the registration and verification process.

3. USER OBLIGATIONS & DATA ACCURACY

Accuracy of Input: You are solely responsible for entering the correct Vehicle Registration Number (VRN), Engine Number, and Chassis Number. Our "Double-Blind Match" relies entirely on the precision of this data.

Lawful Use: You agree not to use the platform for any fraudulent, abusive, or illegal activity.

Communication: Users in the Anonymous Chat must maintain professional conduct. Harassment, threats, or attempts to circumvent the platform's security will lead to immediate termination of service.

4. SERVICE SPECIFICS

Vehicle History Report: Fetches data from government and third-party APIs. Data is provided "as-is."

Connect & Match (Pay-on-Match): We charge a fee only when our system confirms a 100% match between a Seller and a Buyer for a specific vehicle. Once a match is verified and payment is processed, the secure chat room is unlocked.

Legal Shield: This service includes the drafting of sale intimations, demand notices, or public notices. TransferFix handles the logistics of dispatch via Registered Post. You acknowledge that the efficacy of these notices in a court of law depends on your specific transaction history and evidence.

5. PAYMENTS AND FEES

All fees are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

Payment for "Connect" is only requested after a successful system match.

We use third-party payment gateways. We do not store your credit card or net banking credentials.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, TransferFix LLP shall not be liable for:

• Inaccuracies in data fetched from government databases (Vahan/RTO).

• Failure of a buyer to transfer the RC despite receiving a legal notice.

• Any indirect, incidental, or consequential damages arising from the use of our services.

Total liability for any claim shall not exceed the amount paid by the user for the specific service in question.

7. INDEMNITY

You agree to indemnify and hold harmless TransferFix LLP, its partners, employees, and panel lawyers from any claims, losses, or legal fees arising out of your breach of these terms or your submission of false vehicle information.

8. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
